
CALG’s Robert Roth and Charles Kagay have persuaded the California Court of Appeal’s Sixth District to reverse a family law spousal support order of nearly $1 million per year. The trial court had failed to consider a statute from the 1940s which prohibits support awards for a spouse whose separate assets are sufficient to constitute “proper support,” and in this case, both spouses were independently wealthy due to pre-trial distributions of their assets. The appellate court remanded for proceedings that may save CALG’s client many millions of dollars.
