CALG appellate specialist Jens Koepke notched two victories in high-stakes civil appeals in the past few months.
First, in a unanimous published decision, Jens persuaded the Court of Appeal to affirm summary judgment for his client, California State University, in a multimillion-dollar wrongful termination case. The court agreed with CSU that the plaintiff had not submitted sufficient evidence to dispute the legitimate, non-discriminatory reason for his termination, and had not presented enough evidence to establish a hostile work environment claim. The court adopted most of Jens’s appellate arguments on the substantive claims, as well as on a number of evidentiary issues. You can read the opinion in Martin v. Board of Trustees of the Cal. State University by clicking here.
Second, Jens won a complete victory for his client, Pegasus Elite Aviation, obtaining affirmance of a favorable verdict in a 20-day trial with more than $2.5 million at stake. The Court of Appeal agreed with Jens that the trial court did not err in how it interpreted an airplane charter lease agreement or in rejecting the plaintiff’s request for prejudgment interest.
