CALG’s Claudia Ribet and Kirstin Ault have won twice in short order in the California Court of Appeal.
In Kennard v. Reeves, they obtained, along with Charles Kagay, an affirmance of a trial court’s decision to award CALG’s client half of a construction and planning business valued at more than $10 million. The Court of Appeal agreed that post-nuptial estate planning documents transmuted the business from the wife’s separate to community property, despite statements in the documents that purported to automatically terminate the transmutation upon divorce. In In re Marriage of Donahoe, they obtained, along with Susan Horst, a reversal of a trial court’s order quashing a petition for divorce against their client’s ex-spouse for lack of jurisdiction. The Court of Appeal held that the trial court had both general and specific jurisdiction over the ex-spouse, and that even though the ex-spouse had filed a divorce action in Virginia, the case should properly be adjudicated in California.
